Terms of Service
1. Acceptance of Terms
These Terms apply to all users of Ereading.AI, including teachers, students, parents, schools, districts, and visitors. By launching, assigning, completing, or reviewing content through our platform, you agree to comply with these Terms and our Privacy Policy.
If you are accepting these Terms on behalf of a school, district, or organization, you represent that you have the authority to bind that entity.
2. Eligibility and Educational Use
Ereading.AI is designed for educational use. You are responsible for ensuring your use complies with school, district, and local requirements, including parental or institutional permissions where required.
Users under the age of 13 may use Ereading.AI only with the involvement of a parent, teacher, or school acting in accordance with applicable law (including COPPA). Student accounts are created through parent or teacher invite flows, not through independent child registration. Class code access does not require an account or any personal information beyond an optional first name.
3. Accounts and Security
- Accounts are created via Google sign-in or email magic link. We do not use passwords.
- You are responsible for activity under your account, class codes, and assignment links.
- Do not share account access in ways that bypass intended user controls.
- Notify us promptly at [email protected] if you suspect unauthorized use of your account or classroom settings.
- You may delete your account at any time through your account settings. Deletion removes your profile and associated data, subject to our retention policy.
4. Acceptable Use
You agree not to misuse the service. Prohibited behavior includes:
- attempting to bypass authentication, entitlement checks, class code limits, or other platform safeguards;
- probing, scraping, reverse engineering, or extracting content at abusive scale;
- introducing malicious code, abusive traffic, or attempts to disrupt service availability;
- sharing class codes or assignment links publicly or with unintended recipients;
- submitting intentionally harmful, obscene, or illegal content through activity response fields;
- using Ereading.AI for unlawful, deceptive, or non-educational abusive purposes.
We reserve the right to suspend or terminate access for violations without prior notice.
5. Assignment Links, Class Codes, and LMS Integrations
- Assignment settings may be carried in URL parameters or stored in LMS assignment records.
- LMS grade passback depends on provider capabilities and proper assignment creation flow. For Google Classroom, grade passback requires coursework created through our supported integration flow, not a manually pasted link.
- Class codes are intended for classroom use. You are responsible for sharing codes and links with intended students only.
- Class codes are subject to daily usage limits as described in Section 6. Exceeding these limits may result in the code being automatically rotated for abuse prevention.
- We may adjust LMS integration features as platforms update their APIs or terms.
6. Membership Plans and Limits
Ereading.AI offers the following paid plan types. Plan availability, pricing, and specific limits are displayed at the time of purchase and may be updated from time to time:
Teacher Subscription
- Ad-free experience for the teacher and students accessing activities through the teacher's class codes or connected LMS, within the subscription's daily limits.
- AI-assisted grading and feedback on open-ended student responses.
- Stored PDF result documents accessible through the teacher dashboard.
- Up to 5 active class codes at a time (default).
- Up to 150 students per class code (default).
- Up to 250 activity loads per class code per day.
- Up to 100 unique student sessions per class code per day.
Daily limits reset at midnight Central Time. Usage beyond these limits may result in temporary code rotation or reduced functionality for the remainder of the day. These limits exist to prevent abuse and ensure fair access; they are designed to accommodate typical classroom usage.
Student License
- Ad-free experience for the licensed student.
- AI-assisted feedback, tutoring support, and personalized encouragement.
- Persistent activity history and progress tracking in the student dashboard.
- One active student per parent subscription at a time (default).
District and School Plans
District and school plans are available for bulk licensing. Terms, limits, and pricing for institutional plans are established in separate written agreements.
Free Access
All activities and lessons are available for free with advertisements. Free usage does not include AI grading, stored PDF result documents, or ad-free access. Free LMS and class code usage (without a paid subscription) stores activity data for up to 14 days.
Limit Adjustments
We reserve the right to adjust default plan limits (number of class codes, students per code, daily load caps) as the product evolves. We will provide notice of material limit reductions to active subscribers. Institutional agreements may specify custom limits that supersede the defaults above.
7. Billing, Cancellation, and Refunds
Payment Processing
All payments are processed by Stripe. By subscribing, you agree to Stripe's terms of service. We do not store credit card numbers or bank account details on our servers.
Subscription Billing
- Subscriptions are billed in advance on a monthly or annual cycle, depending on the plan selected.
- Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date.
- We may change plan pricing with at least 30 days' notice to active subscribers. Price changes take effect at the next billing cycle after the notice period.
Cancellation
- You may cancel your subscription at any time through your account settings or by contacting [email protected].
- Cancellation takes effect at the end of the current billing period. You retain access to paid features until then.
- After cancellation, your data is retained for 30 days as described in our Privacy Policy, then automatically purged.
Refunds
- Annual plans: A full refund is available within 14 days of the initial purchase if the service does not meet your expectations. After 14 days, refunds are not provided for the remaining term.
- Monthly plans: Refunds are generally not provided for monthly billing periods. If you experience a service issue, contact us and we will evaluate on a case-by-case basis.
- Refund requests can be submitted to [email protected].
Failed Payments
If a payment fails, we will notify you and attempt to process the payment according to Stripe's retry schedule. If payment is not resolved, paid features may be suspended or the subscription may be cancelled.
8. Advertising and Ad-Free Access
Free, non-authenticated usage of Ereading.AI may include standard web advertisements. Ads are not personalized based on student activity data, learning responses, or scores.
Ad-free access is provided in the following contexts:
- Signed-in users with an active paid subscription (teacher or student).
- Students accessing activities through a class code linked to an active teacher subscription, within the subscription's daily usage limits.
- Students launching activities through an LMS connection linked to an active teacher subscription, within the subscription's daily usage limits.
If a class code's daily ad-free session limit is reached, additional students for that day may see advertisements. The teacher's own experience remains ad-free regardless of class code usage.
9. AI-Assisted Feedback and Grading
Paid plans may include AI-assisted scoring and written feedback on open-ended student responses. AI features are provided by third-party AI services, which may include OpenAI, Google, Anthropic, xAI, and others. The specific providers used may change over time based on availability, cost, and quality.
- AI grading sends only educational content to providers (passage text, question, student response, and rubric). No student-identifying information is included. See our Privacy Policy for details.
- AI output is probabilistic and should be treated as an educational aid, not a sole basis for high-stakes academic decisions.
- Teachers and schools are responsible for final grading policies and for reviewing AI-generated feedback as they see fit.
- AI grading is not available on the free tier. Teachers can disable AI grading on a per-assignment basis.
- We do not guarantee the accuracy, completeness, or pedagogical quality of AI-generated feedback.
10. Data Handling and Retention
Our detailed data practices are in the Privacy Policy. Key retention terms:
- Free anonymous usage: stateless processing, no data persisted after the session.
- Free LMS/class-code usage: activity records and PDFs retained for up to 14 days.
- Paid subscriptions: data retained while the subscription is active, plus 30 days after cancellation or expiration.
Data deletion requests can be submitted per our Privacy Policy.
11. Intellectual Property
Ereading.AI platform code, branding, educational content, and original materials are owned by Ereading.AI and protected by applicable intellectual property law. You may not copy, modify, distribute, or create derivative works from our content or platform without written permission.
You retain all rights to content you submit (such as written responses) that you are legally authorized to provide. By submitting content through the service, you grant Ereading.AI a limited, non-exclusive license to host, process, analyze (including via AI grading), and deliver that content within the service for the purpose of providing educational functionality. This license ends when the content is deleted per our retention policy.
12. Third-Party Services
Ereading.AI integrates with third-party services including:
- LMS platforms (Google Classroom, Canvas, Schoology, Moodle, Blackboard, and others) for assignment creation, grade passback, and student launch;
- Google for account authentication (OpenID Connect);
- Stripe for payment processing;
- AI providers (OpenAI, Google, Anthropic, xAI) for automated grading and feedback.
Each third-party service is governed by its own terms of service and privacy policy. We are not responsible for the practices, availability, or security of third-party services. Changes to third-party APIs or terms may affect the availability of integrations.
13. Service Changes and Availability
We may update, improve, suspend, or remove features at any time. We do not guarantee uninterrupted or error-free operation. Service may be affected by:
- scheduled or emergency maintenance;
- third-party provider outages (LMS platforms, AI services, Stripe, hosting);
- events beyond our reasonable control, including natural disasters, internet disruptions, government actions, cyberattacks, and other force majeure events.
We will make reasonable efforts to provide advance notice of planned downtime that may affect classroom workflows.
14. Disclaimer of Warranties
To the maximum extent permitted by law, Ereading.AI is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
Without limiting the foregoing, we do not warrant that: the service will be uninterrupted, secure, or error-free; AI-generated feedback will be accurate or pedagogically appropriate; LMS grade passback will succeed in all configurations; or results will meet specific educational outcomes.
15. Limitation of Liability
To the maximum extent permitted by law, Ereading.AI and its owners, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, loss of academic credit, or interruption of educational workflows, arising out of or related to your use of the service.
Our total aggregate liability for all claims arising out of or related to the service shall not exceed the amounts you have paid to Ereading.AI in the twelve (12) months preceding the event giving rise to the claim, or fifty dollars ($50), whichever is greater.
These limitations apply regardless of the theory of liability (contract, tort, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.
16. Indemnification
You agree to indemnify, defend, and hold harmless Ereading.AI, its owners, officers, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:
- your use of the service in violation of these Terms;
- content you submit through the service;
- your violation of any applicable law or third-party rights;
- unauthorized sharing of class codes, assignment links, or account credentials.
17. Suspension and Termination
- We may suspend or terminate your access for violations of these Terms, abuse, fraud, or security concerns, with or without prior notice depending on severity.
- You may stop using Ereading.AI and delete your account at any time.
- Upon termination, your right to use the service ceases immediately. Data is retained per our retention policy.
- Provisions that by their nature should survive termination will survive, including intellectual property, limitation of liability, indemnification, and dispute resolution.
18. Governing Law and Dispute Resolution
Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Illinois, without regard to conflict of law principles.
Informal Resolution
Before filing any formal legal proceeding, you agree to attempt to resolve any dispute informally by contacting us at [email protected]. We will attempt to resolve the dispute within 30 days of receiving your written description of the issue.
Jurisdiction
If informal resolution is unsuccessful, any legal action or proceeding shall be brought exclusively in the state or federal courts located in the State of Illinois, and you consent to the personal jurisdiction of such courts.
19. General Provisions
- Entire Agreement. These Terms, together with our Privacy Policy and any separate written agreements (such as institutional or district agreements), constitute the entire agreement between you and Ereading.AI.
- Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
- Waiver. Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
- Assignment. You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights and obligations without restriction.
- Force Majeure. We are not liable for delays or failures in performance resulting from events beyond our reasonable control, including natural disasters, internet disruptions, third-party service outages, government actions, or cyberattacks.
20. Changes to Terms and Contact
We may update these Terms as the product evolves. Updated terms are effective when posted to this page. We will provide at least 30 days' notice for material changes that affect paid subscribers. Continued use after the effective date of updated terms constitutes acceptance.
For questions about these Terms, contact [email protected].
